Gem Studio Privacy Policy

This privacy policy is applicable to the Gem Studio app (hereinafter referred to as "Application") for mobile devices, which was developed by Artsem Akhuba (hereinafter referred to as "Service Provider") as a free, ad-supported service with an optional paid subscription and optional in-app purchases. This service is provided "AS IS".

What information does the Application obtain and how is it used?

The Application acquires the information you supply when you download and register within the Application. When you create an account, the Service Provider collects the information you provide, such as your email address, your display name, and, if you sign in with Google, basic profile information made available by your Google account. If you sign in with Apple, Apple shares your name (only the first time you sign in; it is saved as your display name) and either your email address or, if you choose Hide My Email, a private relay address that forwards to it.

While you use the Application, content you create is stored in your account, such as your saved jewelry designs, your AI credit balance, the materials you acquired in versions of the Application before 3.0, and your preferences (for example, language and theme). This information is used to provide the core functionality of the Application, to sync your data across devices, and to restore it when you reinstall the Application.

The Service Provider may also use the information you provided them to contact you from time to time to provide you with important information and required notices.

What information does the Application collect automatically?

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device's unique device ID and advertising identifier, your mobile operating system, the IP address of your mobile device, and information about the way you use the Application. This information is used to operate the service, keep it secure, improve the Application, and — in the case of the advertising identifier — to serve advertisements.

Does the Application collect precise real-time location information of the device?

This Application does not gather precise information about the location of your mobile device.

Does the Application collect diagnostics and crash reports?

The Application uses Firebase Crashlytics, a service provided by Google, to identify crashes, diagnose selected unexpected technical failures, and improve application stability. When a crash or selected unexpected error occurs, Crashlytics may receive technical information such as the original error message and name, error code and stack trace, device and operating-system information, application version and build number, runtime and update identifiers, platform, and application language.

The Application does not explicitly set a Firebase Authentication user ID in Crashlytics or attach credentials, authentication tokens, or full account and jewelry design records to diagnostic reports. Original error messages may contain identifiers, file paths, or other values involved in the failing operation. Reports may also include Analytics breadcrumbs describing preceding activity, including material and design attributes, virtual currency events, and purchase amounts, currencies, and transaction identifiers.

Crash reports are processed and retained by Google under the Firebase terms and privacy documentation. Because these reports are stored by Crashlytics rather than in your Gem Studio account record, deleting your Gem Studio account does not automatically delete previously collected crash reports.

Does the Application use Artificial Intelligence (AI) technologies?

Yes. The Application offers an optional feature that creates a photorealistic image of a jewelry design you have built. It runs only when you start it for a particular design, and never on its own.

When you use it, the Application sends the image of your design, the contents of that design (such as the beads it is made of and its length), and the scene options you selected to the Service Provider's server. The server assembles a text description from that information and sends it, together with the image of your design, to Google's Gemini image generation service, which produces the resulting picture.

The Application does not send free-form text to the image generation service. There is no prompt field: the scene is chosen from a fixed set of options offered by the Application, and the wording sent on your behalf is written by the Application rather than by you.

Generated images are stored in Firebase Cloud Storage under your account, together with a record of the design and the scene options each image was created from. Images produced by Google carry an invisible SynthID watermark that identifies them as AI-generated.

Does the Application show advertising?

The Application displays advertisements served by third-party advertising networks, such as Google AdMob, to users without an active GemStudio Premium subscription. These networks may collect and use your device's advertising identifier and other information described in their own privacy policies to serve ads, including personalized ads where permitted. You can limit or reset personalized advertising at any time in your device settings.

On iPhone and iPad, the Application accesses your device's advertising identifier (IDFA) only if you allow tracking when Apple's App Tracking Transparency prompt asks you. You can change your choice at any time in Settings → Privacy & Security → Tracking. If you do not allow tracking, ads are still shown, without access to that identifier.

Does the Application offer in-app purchases?

The Application offers an optional auto-renewing subscription (GemStudio Premium), with a free trial where offered, and in-app purchases of AI credits. All payment transactions are processed by the operator of the app marketplace you use, Google Play or the App Store, under their own terms and privacy policies. The Service Provider does not collect or store your payment card details.

Purchases and subscriptions are managed through RevenueCat, which receives your Gem Studio account identifier together with your purchase and subscription records (such as the product, price, currency, purchase and renewal dates, and subscription status) so the Application can determine what you have access to. The Service Provider's server reads your subscription payment history from RevenueCat to add the monthly AI credits that paid subscription months earn. Your AI credit balance and a record of credit purchases, bonuses, and use are stored in your account.

Do third parties see and/or have access to information obtained by the Application?

Information described in this policy may be transmitted to external services as needed to provide account authentication, cloud synchronization, advertising, app distribution, and crash diagnostics. These service providers process information under their own terms and privacy policies. The Service Provider may share your information with third parties only in the ways described in this privacy statement.

The Service Provider may disclose User Provided and Automatically Collected Information:

as required by law, such as to comply with a subpoena, or similar legal process;
when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
with their trusted services providers who work on their behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

What are my opt-out rights?

You can halt all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also delete your account and its cloud data at any time, as described below.

How can you delete your account and data?

You can delete your account directly in the Application: open the Profile tab and choose the account deletion option. Deleting your account removes your authentication record and the data associated with your account, such as saved designs, AI-generated images, AI credits, and material inventory. If you signed in with Apple, deleting your account also revokes the Application's Sign in with Apple authorization.

Deleting your account does not cancel a subscription or free trial; cancel it first in Google Play or, for an App Store subscription, in your Apple Account settings (Settings → your name → Subscriptions).

What is the data retention policy and how can you manage your information?

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. The Service Provider will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate.

AI-generated images are kept until you delete them, delete the design they belong to, or delete your Gem Studio account. Each of those actions removes the stored images it covers; they are not deleted on a schedule.

So that the same subscription payment never earns AI credits twice, the Service Provider keeps a record of which payments have already been credited. It holds a one-way digest of the account identifier rather than the identifier itself, and it is kept after the account is deleted.

If you'd like the Service Provider to delete User Provided Data that you have provided via the Application, please contact them at gemstudio.app@gmail.com and they will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

How does the Application address children's privacy?

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discovers that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided personal information, please contact the Service Provider at gemstudio.app@gmail.com so that they will be able to take the necessary actions.

How is your information kept secure?

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information they process and maintain. For example, access to this information is limited to authorized persons who need to know that information in order to operate, develop, or improve the Application. Please be aware that, although they endeavor to provide reasonable security for information they process and maintain, no security system can prevent all potential security breaches.

How will you be informed of changes to this Privacy Policy?

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

How do you give your consent?

By using the Application, you are giving your consent to the Service Provider's processing of your information as set forth in this Privacy Policy now and as amended by them. "Processing" means using cookies on a computer or hand-held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.
